Before you proceed, please take a moment to read these Terms & Conditions ("Terms") carefully. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, then you may not access the Service.
The Service is provided by Spectro.AI SRL (“Service provider”, “We”, “Us”), a company registered at Romanian Trade Registry, and is located at Mircea Eliade street 38A/11, 400354, Cluj-Napoca, Romania, European Union.

1. Eligibility

1.2 The Service is intended for use worldwide. Access to the Service may not be legal for certain persons or in certain countries. It is your responsibility to ensure compliance with all applicable laws in your jurisdiction.

2.1 The Service may provide general health and fitness information, but it is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition.
2.2 You acknowledge that the use of any fitness programs, exercises, or nutritional advice provided through the Service is at your own risk. We shall not be liable for any injuries, damages, or losses resulting from such activities.
3. Privacy Policy
3.1 Your privacy is important to Us. Our Privacy Policy explains how We collect, use, and disclose information about you when you use the Service. By using the Service, you consent to our Privacy Policy.
4. User Accounts
4.1 In order to access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and password, and you agree to accept responsibility for all activities that occur under your account.
4.2 You may request to have your user account removed by contacting our customer support team at support@spectro.life or by following the appropriate instructions in the Privacy Policy. The removal of your user account and associated data may be subject to legal obligation to retain certain information.
4.3 We reserve the right to terminate or remove user accounts, at our sole discretion and without prior notice, for any reason, including but not limited to:

Engagement in any prohibited activities as outlined in Section 8 of these Terms.
4.4 In the event of termination or removal of your user account, you may lose access to certain features and content within the Service. We shall not be liable for any loss or damage arising from the removal of a user account.
5. Data Access Requirements
5.1 To provide the full functionality of our app on iOS devices, We require access to Motion & Fitness data. For Android devices, We require access to Activity Recognition / Physical Activity data and precise background location.
5.2 It is the responsibility of the user to allow access to this personal data. Please note that without this data, certain features of the app may not be available.
5.3 In case of rejection of data access, the user is not eligible for a refund as part of the service is already performed.
6. Media Usage
6.1 Media posted on the Service's website, social networks, or video streaming channels, including but not limited to images, videos, and audio recordings, are the exclusive property of Spectro.AI SRL.
6.2 Media posted on the Service's website, social networks, or video streaming channels must not be copied, reproduced, reused, distributed, or modified without explicit consent from Spectro.AI SRL.
7. Removal of Unacceptable Social Media Posts
7.1 The Service provider reserves the right to review and monitor all posts on Spectro.Life’s social media.
7.2 The Service provider may, at its sole discretion, remove any social media post that it deems unacceptable, including but not limited to posts containing offensive, inappropriate, or harmful content.
7.3 Users whose posts are removed due to unacceptable content may be subject to further actions, including the suspension or termination of their access to the Service.
8. Intellectual Property
8.1 The Service and its original content, features, and functionality are and will remain the exclusive property of Spectro.AI SRL and its licensors. The Service is protected by copyright, trademark, and other laws.
8.2 You may not copy, modify, distribute, sell, or lease any part of the Service unless expressly authorized by Us in writing.
9. User License and Restrictions
9.1 The Service provider grants users a personal, non-transferable, and non-exclusive right and license to use the App and Website, provided that the user does not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right in the Software.
9.2 Users agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Site.
9.3 Users agree not to access the App and Website by any means other than through the interface that is provided by Spectro.AI SRL for use in accessing the App and Website.
10. Linking to the App and Website
10.1 You may link to the App and Website, provided that the link:

Is not in any way misleading;

Does not falsely imply sponsorship, endorsement, or approval of the linking party and its products or services;

Fits within the context of the linking party's site.
10.2 We reserve the right to request the removal of any link to the App and Website that we consider inappropriate or inconsistent with our brand guidelines.
11. Use of Spectro.Life's Logo and Iframes
11.1 Spectro.Life's logo can only be utilized with our explicit approval. The use of the logo must adhere to our brand guidelines, and you must obtain our prior written consent before using the logo on any platform or material.
11.2 You may not modify, alter, or distort the logo in any manner.
11.3 The logo should not be used in any way that could confuse or mislead users about any affiliation or endorsement by Spectro.AI SRL.
11.4 Spectro.AI SRL reserves the right to request the removal of its logo from any platform or material that does not comply with these terms.
11.5 Without prior approval and express written permission, you may not create frames around our Website pages or use other techniques that alter in any way the visual presentation or appearance of our Website.
12. Prohibited Activities
12.1 When using the Service, you agree not to engage in any of the following activities:

Uploading or transmitting any harmful or malicious code;

13. Limitation of Liability

13.2 The aggregated liability for any direct damages shall be limited to the lesser of:
(i) Membership fees paid by the user; or (ii) Membership fees paid by the user during the previous calendar year.
14. Indemnification
14.1 You agree to indemnify and hold harmless Spectro.AI SRL and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
15. Governing Law and Jurisdiction
15.1 These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.
15.2 You expressly agree that exclusive jurisdiction for any dispute arising out of or relating to these Terms or the use of the Service resides in the Justice Court of Cluj-Napoca, Romania.
16. Modifications to Terms
16.1 We reserve the right to modify these Terms at any time. The updated version of the Terms will be posted on the Service, and your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
